The Terms and conditions and the Privacy Policy together compose a legal agreement ("Agreement") between you and aapkaclinic in connection with your visit to the Website and your use of the Services.

For Patients
End-Users, representatives, or affiliates searching for Practitioners through the Website.
For Practitioners
Medical practitioners, healthcare providers, or institutions listed or wishing to be listed on the Website.
Nature of Services
The Services may change from time to time, at the sole discretion of aapkaclinic, and the Agreement will apply to your visit to and your use of the Website to avail the Service, as well as to all information provided by you on the Website at any given point in time.
Acceptance of Terms
By downloading or accessing the Website to use the Services, you irrevocably accept all the conditions stipulated in this Agreement, the Subscription Terms of Service and Privacy Policy, and agree to abide by them. This Agreement supersedes all previous oral and written terms and conditions relating to your use of the Website.
Eligibility
By registering, visiting and using the Website, you represent and warrant to aapkaclinic that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website and the Services available through the Website.
Account & Security
The User is responsible for maintaining the confidentiality of the User's account access information and password. The User shall be responsible for all usage of the User's account and password, whether or not authorized by the User.
Aapkaclinic will not be liable for your losses caused by any unauthorized use of your account, but you may be liable for the losses of aapkaclinic or such other parties due to such unauthorized use.
Data Collection & Privacy
aapkaclinic may collect information relating to the devices through which you access the Website, and anonymous data of your usage. The collected information will be used only for improving the quality of aapkaclinic's services and to build new services.
The Website allows aapkaclinic to have access to registered Users' personal email or phone number for communication purposes, booking appointments, and obtaining feedback.
Practitioner Listings
aapkaclinic collects, directly or indirectly, and displays on the Website, relevant information regarding the profile and practice of the Practitioners listed on the Website, such as their specialization, qualification, fees, location, visiting hours, and similar details. aapkaclinic takes reasonable efforts to ensure that such information is updated at frequent intervals. Although aapkaclinic screens and vets the information and photos submitted by the Practitioners, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.
aapkaclinic's relevance algorithm for Practitioners is a fully automated system. These listings do not represent any fixed objective ranking or endorsement by aapkaclinic. We are not responsible for the accuracy and the relevancy of the listing order on the Website.
Medical Emergency
If you are facing a medical emergency (either on your or another person's behalf), please contact an ambulance service or hospital directly.
Liability & Responsibility
The results of any search Users perform on the Website for Practitioners should not be construed as an endorsement by aapkaclinic of any such particular Practitioner. If the User decides to engage with a Practitioner to seek medical services, the User shall be doing so at his/her own risk.
aapkaclinic is NOT liable for:
- Any wrong medication or quality of treatment being given by the Practitioner(s), or any medical negligence on part of the Practitioner(s).
- Inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the User due to a failure on the part of the Practitioner to provide agreed Services.
- Any misconduct or inappropriate behaviour by the Practitioner or the Practitioner's staff.
- Cancellation or no show by the Practitioner or rescheduling of booked appointment or any variation in the fees charged.
- Any damages to, or viruses that may infect User's equipment on account of User's access to, use of, or browsing the Website.
Users will not be entitled for any refunds in any cases.
User Conduct & Feedback
Users are allowed to provide feedback about their experiences with the Practitioner in accordance with applicable law. However, aapkaclinic shall not be obliged to act in such manner as may be required to give effect to the content of Users feedback.
If aapkaclinic determines that you have provided fraudulent, inaccurate, or incomplete information, aapkaclinic reserves the right to immediately suspend your access to the Website and makes such declaration on the website alongside your name/your clinic's name.
If a User has utilized the telephonic services, aapkaclinic reserves the right to share the information provided by the User with the Practitioner and may store such information/conversations in accordance with our Privacy Policy.
Abusive Language Policy
Users shall not use abusive language with the Practitioner. In the event of abuse being reported, QTIPL reserves the right to terminate the Service and shall not provide such Services in the future.
Online Consultations (Consult)
The User understands that Consult shall not form a substitute for treatment that otherwise needs physical examination/immediate consultation. Advice is based on general medical practices prevalent in India.
Conditions for Using Consult:
- You must have an ongoing treatment with a medical practitioner.
- Condition must NOT require emergency treatment or physical examination.
- Medical history and previous reports must be available for reference.
- Consult your doctor before abandoning or modifying ongoing treatment.
Prescriptions
Practitioners may upload prescriptions to your account. For users outside India, prescriptions are issued at the Practitioner's sole discretion.
Media Sharing
Users may share images/videos of affected areas only if absolutely necessary for diagnosis and if comfortable doing so.
Restricted Drugs Policy
Users shall not persuade Practitioners to prescribe restricted drugs. These include:
- MTP Medications
- Sedatives & Hypnotics
- Opioids
- Schedule X Drugs
- 4th Gen Antibiotics
Termination & Suspension
aapkaclinic reserves the right to suspend or terminate a User's access to the Website and Services with or without notice if:
- User breaches any terms and conditions of the Agreement.
- A third party reports violation of any rights due to your use of Services.
- Inability to verify or authenticate information provided by the User.
- Reasonable grounds for suspecting illegal, fraudulent, or abusive activity.
Dispute Resolution
Arbitration
Any dispute, claim or controversy arising out of or relating to this Agreement shall be settled by arbitration in the English language. The award shall be final and binding on all parties.
Gandhinagar Jurisdiction
The courts at Gandhinagar shall have exclusive jurisdiction over disputes relating to this Agreement and use of the Website.
Refund Policy
Users will not be entitled to any refunds in any cases. QTIPL is not responsible for honouring any refund request towards consultations paid to QTIPL.
Q&A Platform
The Q&A Platform is a public forum for exchange of information of general nature. It is NOT a consultation or medical advice.
- • Practitioners cannot issue and/or prescribe any medicines on the Q&A platform.
- • Any question posted is visible publicly; do not publish confidential information.
- • Practitioners shall not share personal, religious and/or moral views.
Practitioner Obligations
Practitioners represent and warrant that they are duly registered, licensed, and qualified to practice medicine as per laws. Any contravention of law as a result of your use of these Services is your sole responsibility.
aapkaclinic reserves the right to take down or display any Practitioner's profile with or without notice. Practitioners explicitly agree that aapkaclinic reserves the right to publish the Content provided to third parties.
aapkaclinic reserves the right to make the final decision in case of a conflict.
